PROVISIONS PERTAINING SPECIFICALLY TO INTERNET BANKING
Confidentiality and Security
The Internet banking feature of this Website supports versions of Netscape Navigator™ and Microsoft® Internet Explorer that use 128-bit encryption. Encryption is a means of “scrambling” information for transmission between computers. The information is “scrambled” by the software on your computer and transmitted in a “scrambled” form to ECU’s computers, which have software to “unscramble” the information.
TM Netscape is a registered trademark and Netscape Navigator is a trademark of Netscape Communications Corporation.
® Microsoft is a registered trademark of Microsoft Corporation.
ECU enforces the use of 128-bit encryption for all financial transactions conducted using the Internet banking feature available on this Website, because of the added risk of breaches of confidentiality and security using the older, less secure 40-bit encryption technology.
Please be aware that any e-mail messages you forward to us are NOT encrypted in any way, and are therefore as insecure, and as open to interception, as any other non-encrypted form of communication (e.g. ordinary mail, conversations on ordinary or cellular telephones, etc.). ECU accepts no responsibility for the security of confidential information forwarded to it by e-mail, and expressly discourages members from doing this.
Although ECU makes all reasonable efforts to ensure the security of Internet banking, ECU cannot warrant its complete security, even using 128-bit encryption technology.
Members’ Responsibility for Security
You must become familiar with, and be constantly aware of, the icon used by your browser to indicate the encryption status, and therefore the security, of your connection with ECU. You agree not to enter the Internet banking function of this Website, or, having entered it, to exit it without conducting any transactions, if your browser does not indicate that you have a secure connection with ECU.
You agree not to leave your computer unattended while conducting an Internet banking session. You also agree not to leave your computer unattended after having completed an Internet banking session without first terminating the session, exiting the Website, and exiting the browser to erase any temporary files which might contain confidential information in non-encrypted form.
You must also be aware that Internet banking files may exist in a non-encrypted state in your computer’s permanent memory until erased. You agree to secure or erase these files as soon as possible after completing each Internet banking session.
Use of the Internet banking function requires an alias and a password. ECU will be aware of the alias you select, but not your password. Although you must disclose your alias to ECU, you agree to select an alias which will not identify you or be easily traceable to you. You agree not to disclose your password to any person, and to take all necessary precautions to ensure no one becomes aware of your password while you are entering it into your computer.
You agree to notify ECU, at 905-426-1389, immediately if you become aware of any breach of security or any unauthorized access to your accounts.
ECU accepts no responsibility for unauthorized use of your alias and/or password, and accepts no obligation to confirm the identity of any user of Internet banking. You agree that access to Internet banking using your alias and password is the legal equivalent of your written signature. You will be responsible for, and bound by, all transactions conducted by using your alias and password to access Internet banking, whether those transactions were done by you, by another person with your consent (e.g. your attorney under a Power of Attorney, or an employee of your business), or by another person without your consent.
Accuracy of Information Provided by Internet Banking
Internet banking obtains its information from ECU’s banking system. If there is a discrepancy between information provided by Internet banking and the information existing in ECU’s banking system, the information in ECU’s banking system shall be deemed to be correct.
Access to Internet Banking
ECU will make all reasonable efforts to provide uninterrupted Internet banking access, but cannot guarantee such access. ECU accepts no responsibility for damages caused by non-acceptance or non-receipt of transactions, or partial implementation of transactions, or delay in performance of transactions caused by errors in the operation of, or the non-availability of, the Internet banking function.
Amendments
The terms and conditions of this agreement may change at any time. ECU will notify you of these changes by email to your e-mail address as shown on ECU’s records, or by posting the changes on this Website. You agree to read carefully all such notifications of changes to this agreement. Changes to this agreement may state an effective date; if they do not, the changes are immediately effective. Use of Internet banking following the effective date of such changes constitutes acceptance of them.
Termination
ECU may terminate the Internet banking function, or this agreement, at any time without notice to you. ECU accepts no responsibility for any damages you incur as a result of the withdrawal of the Internet banking function or restrictions placed on your use of it.
Use Constitutes Acceptance
Use of Internet banking constitutes your acceptance of the terms of this agreement.
